CRIMINAL LAW ESSAY ONE
Cal and Dan entered a jewelry store, drew guns and ordered the owner of the jewelry store (Opal), to lie down on the floor. Cal and Dan proceeded to the jewelry case displays and began taking items of jewelry. While lying on the floor, Opal managed to activate a silent alarm that alerted the police department. Officer Pat, a police officer, arrived at the jewelry store just as Cal and Dan were running to their vehicle intending to drive away with the stolen jewelry. Cal aimed his weapon and fired several shots at Officer Pat that narrowly missed Officer Pat and fortunately also missed a crowd of spectators that had gathered once they heard the siren from Officer Pat’s police vehicle. Officer Pat returned fire, but the gunshots missed the intended target. Opal followed Cal and Dan outside the jewelry store intending to get a good look at the getaway vehicle and its license plate. Opal had also taken a gun from the jewelry store and ran out chasing Cal and Dan as they drove away. One of Officer Pat’s shots struck the getaway vehicle, bounced off and ended up striking and killing Opal.
Both Cal and Dan were subsequently arrested. If both are charged with first and second-degree murder in connection with the death of Opal, are the facts stated above sufficient to sustain the charges
